These terms and conditions explain how Amaze Blinds & Curtains supplies goods and services to its customers.
They apply to orders for blinds, curtains, shutters, accessories, measuring, fitting and related services. Therefore, please read them carefully before placing an order.
By approving an Order Confirmation or otherwise accepting an order, you agree to these terms and conditions.
We may update these Terms from time to time. However, the Terms that apply to your order will normally be those in force when your contract is formed.
These Terms and any contract between us are available in English.

We make every reasonable effort to display colours accurately. However, screens and printed materials can display colours differently.
Therefore, the colour of a finished product may vary slightly from the image you have seen.
Where colour or texture is important, we strongly recommend viewing or requesting a sample before ordering.
Samples represent the general appearance of a fabric. However, colour and texture can vary between manufacturing batches.
If an exact shade is especially important, please tell us before ordering.
Where possible, we can arrange a stock cutting from the current batch.
Some samples may be labelled on either side.
Therefore, if you are unsure which side should face into the room, please ask us before placing your order.
We make every reasonable effort to manufacture products accurately.
However, some fabrics naturally stretch, shrink or move. As a result, finished measurements may vary slightly.
Where exceptionally precise sizing is required, please discuss this with us before ordering.
All products remain subject to availability.
If an item becomes unavailable after you order, we will contact you as soon as reasonably possible.
Where appropriate, we may offer an alternative product. Otherwise, we will arrange a refund for any unavailable item already paid for.
Manufacturers occasionally update product specifications.
Therefore, we may supply an updated specification where the change does not materially reduce the product’s appearance, quality or performance.
We may also make changes when required by law or safety standards.
If you provide your own measurements, we will manufacture the products using those measurements.
You are responsible for checking their accuracy.
However, if you would like us to measure your windows, please ask about our measuring service before ordering.
We quote separately for individual products and services.
Where requested, your quotation may also include measuring, delivery or fitting.
If we measure your windows but you do not use our fitting service, please tell us beforehand.
This allows our team to provide any relevant fitting information.
If you fit products yourself, please follow the instructions carefully.
We may charge for alterations or additional visits where a problem results from incorrect fitting by you or another third party.
We will explain any additional charge before carrying out the work.
Some windows require ladders, towers or specialist access equipment.
We normally include standard fitting equipment within the agreed fitting charge.
However, unusual access requirements may not become apparent until we attend the property.
If specialist equipment or additional labour is necessary, we will discuss this with you.
We may then agree an additional reasonable charge before continuing.
In addition, additional equipment may extend the time required to complete the installation.
Our fitting quotation normally assumes one fitting visit.
It also assumes that we can safely access the relevant windows and obtain suitable fixings.
Before our fitter arrives, please remove furniture, ornaments and other items that obstruct access.
Occasionally, the condition of a wall, ceiling or surrounding structure may prevent safe installation.
If this happens, we may need to postpone the fitting until the necessary building work has been completed.
We do not normally undertake structural or remedial building work.
If we need to return because the area was inaccessible or unsuitable, an additional charge may apply.
However, we will explain the reason for that charge before arranging the additional visit.

We only use personal information where we have an appropriate reason to do so.
This section applies when you purchase mainly for personal, domestic or household purposes.
You must be at least 18 years old to enter into a contract with us.
Nothing in these terms and conditions removes or limits the statutory rights available to consumers.
This section applies when you purchase products or services wholly or mainly for business purposes.
If you place an order on behalf of a business, you confirm that you have authority to bind that business.
These Terms and your Order Confirmation form the agreement between us.
However, nothing in these Terms excludes rights or liabilities that cannot legally be excluded.

Before an order becomes binding, we will normally provide details of the products or services you have requested.
Where we issue an Order Confirmation, please check it carefully.
It should set out the agreed products, measurements, specifications, prices and relevant services.

A contract is formed when we accept your order in accordance with the agreed process.
We will provide an estimated delivery or fitting timescale where possible.
However, manufacturing and delivery dates can sometimes change for reasons outside our reasonable control.
If a significant delay occurs, we will contact you.
Delivery is complete when we deliver the products to the agreed address or you collect them.
You become responsible for the products once delivery has taken place.
Ownership transfers to you once we receive full payment.
If nobody is available to receive a delivery, the carrier may leave instructions explaining how to rearrange it.
Additional delivery charges may apply if another delivery attempt becomes necessary.
Many of our blinds, curtains and other window treatments are manufactured specifically for individual customers.
Typical production times may vary according to the product, fabric, manufacturer and time of year.
Where we provide an estimated production time, that estimate begins once we have received all required information and any agreed deposit.
If material becomes unavailable or fails quality inspection, the order may take longer.
We will contact you if we become aware of a significant delay.
Where a delivery would normally require a signature, you may sometimes ask for the goods to be left without one.
We may require written authorisation before agreeing.
If you ask for goods to be left in this way, responsibility for them may pass to you when they are delivered to the authorised location.
If we arrange for goods to be returned by courier, please package them appropriately.
You are responsible for taking reasonable care when packaging goods for transport.
However, this does not affect your statutory rights where products are faulty or not as described.
We may be able to deliver some products outside the United Kingdom.
However, restrictions differ between countries.
Therefore, please contact us before ordering if you require international delivery.
You are normally responsible for any customs duties, import taxes or local charges imposed by the destination country.
You must also ensure that the products may lawfully be imported and used at the destination.
Where we create original drawings, designs or other bespoke design work, intellectual property rights may remain with us.
This does not affect your ownership of products that you have purchased and paid for.
If ownership of a particular design is important to your project, please discuss this with us before ordering.
Please contact us as soon as reasonably possible if you believe there is a problem with a product or service.
We will investigate the issue and explain the appropriate next step.
Where appropriate, we may inspect, repair, replace or otherwise resolve the problem.
Consumers have statutory rights relating to faulty goods and services that are not provided with reasonable care and skill.
Nothing in these Terms limits those statutory rights.
The Consumer Rights Act 2015 provides important protections relating to goods and services supplied to consumers.
The price payable will normally be the price stated in your accepted quotation or Order Confirmation.
Prices may change before an order is accepted.
However, a later general price increase will not normally alter an already agreed order.
Prices will include or exclude VAT as stated on the quotation or Order Confirmation.
Where VAT applies, we will charge it at the legally applicable rate.
Delivery charges are separate unless we specifically include them in the agreed price.
We will normally explain applicable delivery charges before you approve your order.
Despite reasonable checks, pricing errors can occasionally occur.
If we identify an obvious error before completing the contract, we will contact you.
You may then choose whether to proceed at the correct price or cancel the affected order.
Please give us as much notice as possible if you need to change a fitting appointment.
Where a fitting team has already been allocated, reasonable cancellation charges may apply.

However, we may reduce or waive a charge if we successfully reallocate the fitting team.
Any charge must remain reasonable and reflect the circumstances.
Current CMA guidance warns businesses that disproportionate cancellation charges may be considered unfair. Therefore, cancellation charges should reflect legitimate costs rather than operate as a penalty.
Curtain and blind specifications vary according to the product selected.
Your quotation or Order Confirmation will set out the specification included in your order.

Where an optional extra carries an additional cost, we will include that cost in the quotation or explain it before you approve the order.
Available payment methods will be explained when you place your order.
We may require a deposit before ordering bespoke or made-to-measure products.
The remaining balance will become due at the time stated in your quotation, invoice or Order Confirmation.
We may delay ordering, delivery or installation where an agreed payment remains outstanding.
All new residential blinds, curtains and shutters supplied and installed by Amaze Blinds & Curtains include our five-year guarantee from the installation date.
The guarantee covers defects in materials and workmanship during normal domestic use.
Commercial installations include a 12-month product and workmanship guarantee, unless we agree otherwise in writing.
The guarantee does not normally cover:
The guarantee is provided in addition to your statutory consumer rights.
Therefore, it does not replace or restrict those rights.
Nothing in these Terms excludes or limits liability where the law does not allow us to do so.
This includes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.
Subject to those legal restrictions, we will not normally be responsible to a business customer for indirect or consequential business losses.
These may include loss of profit, revenue, anticipated savings, opportunity or goodwill.
Where legally permitted, our total liability relating to an order will not exceed the price paid for the relevant products or services.
We are responsible for foreseeable loss or damage caused by our breach of contract or failure to use reasonable care and skill.
However, we are not responsible for loss or damage that was not reasonably foreseeable.
Where we install products at your property, we will take reasonable care.
If we negligently damage your property during installation, we will take appropriate steps to address that damage.
However, we are not responsible for pre-existing faults, defective structures or damage that already existed.
Nothing in these Terms excludes liability that cannot legally be excluded.
Consumer cancellation rights depend on what you buy and how the contract is entered into.
The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 provide cancellation rights for many distance and off-premises contracts.
However, important exceptions apply.
The statutory cooling-off cancellation right does not normally apply to goods made to a customer’s specifications or clearly personalised.
This can include made-to-measure blinds, curtains and other products manufactured specifically for your measurements or requirements.
Therefore, please check all measurements, colours and specifications carefully before approving your order.
Where a statutory cancellation right applies, you should tell us clearly that you wish to cancel.
We will then explain the applicable return and refund procedure.
Nothing in these terms and conditions reduces your statutory rights concerning faulty, damaged or misdescribed products.
Where you are legally entitled to a refund, we will process it in accordance with applicable consumer law.
Where appropriate, we may refund the original delivery charge up to the value of the least expensive standard delivery method offered.
If goods must be returned, you should take reasonable care of them until they reach us.
Different rules may apply where goods are faulty or not as described.
Occasionally, we may need to cancel an order because of circumstances outside our reasonable control.
Examples include unavailable materials, manufacturer problems or circumstances that prevent us from safely providing the service.
If we cancel before supplying goods or services, we will refund payments relating to anything we cannot provide.
We will contact you as soon as reasonably possible if this happens.
We will not be responsible for delays or failures caused by events outside our reasonable control.
Examples may include:
If such an event affects your order, we will contact you where reasonably possible.
We will also try to provide a revised delivery or fitting date.
References to communication “in writing” include email.

We may transfer our rights or obligations under a contract to another organisation.
However, this will not reduce your legal rights.
You may only transfer your contractual rights or obligations where we agree or where the law allows you to do so.
Unless these Terms expressly state otherwise, the contract is between you and us.
No other person will normally have a right to enforce its terms.
Each section of these terms and conditions operates separately.
Therefore, if a court or other competent authority decides that one provision is unlawful or unenforceable, the remaining provisions will continue to apply.
If we do not immediately enforce a contractual right, that does not mean we have permanently waived that right.
Similarly, a delay in enforcing one obligation does not prevent us from enforcing it later.
If you are a consumer, these Terms are governed by English law.
The courts of England and Wales will have jurisdiction, subject to any additional rights available to consumers living elsewhere in the United Kingdom.
For example, consumers living in Scotland or Northern Ireland may also have rights to bring proceedings in their local courts.
